(“OutVoice”, “Us”, “We”, or “Our”) operates an online payments management platform and online marketplace for businesses, such as but not limited to publishers and editors, to connect and transact with their freelance independent contractors, such as writers, photographers, and other similar creative content providers (the “OutVoice Platform” or “Services”). The OutVoice Platform provides an automated and efficient process for both businesses and freelance independent contractors to communicate and transact with each other and to control and manage their solicitations, offers, purchases, sales, and payments for content. OutVoice is an online platform for professionals.  Businesses and individuals register with OutVoice and use OutVoice’s Services for business purposes, transactions, and opportunities.

The OutVoice Platform and Services are accessible at www.OutVoice.com and may be Used only by Registered Users upon acceptance of Our Terms of Service and Privacy Policy.  This Privacy Policy applies to both OutVoice’s Registered Users and non-registered visitors to our Site.  This page contains OutVoice’s Privacy Policy regarding the collection, use, and disclosure of personal data Our OutVoice Platform and Services.

User Consent To Collection And Use Of Information And Data

The OutVoice Platform and Services operate as an efficient way to exchange information between its Registered Users, who consist of freelance independent contractors of all kinds, including who create content intended for publication and businesses such as publishers and editors who solicit and purchase such content. As an integral part of this exchange of information, OutVoice receives data from its Registered Users, primarily for the purpose of providing the OutVoice Services to its Users.  As the OutVoice Platform is new and growing, OutVoice also uses such information and data to improve and further develop its Services.

OutVoice does not sell the information and data it collects from or regarding its Registered Users to third parties.

By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy. Information And Data OutVoice Collects From Users

OutVoice will collect information and data regarding agreements that You enter into with other Registered Users, such as independent contractor agreements with businesses such as publishers and editors.  OutVoice will collect information and data regarding transactions – purchases and sale of content – that you make through Your use of the Services, including the date and amount of the transaction, the means and process to complete the transaction, and information regarding the content that was purchased or sold.

OutVoice may also collect usage information and data, including Your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the web pages on OutVoice’s Site that You visit, the time and date of Your visit, unique device identifiers, and other diagnostic data.

This information is collected when You create an Account and become a Registered User, when You update Your Account and user profile information, when You use the Services and interact with other Registered Users, when You enter into independent contractor agreements with other Users, and when You enter into transactions with other Registered Users.  Information is also collected when You respond to requests by OutVoice or when collection is required by OutVoice for legal compliance reasons.

 

Use Of Information And Data Collected From Users

Information provided by or collected from Registered Users will be used primarily to provide the Services to Registered Users. The information will be used to contact and communicate with Registered Users, to maintain and manage User accounts, to facilitate management, operation, functionality, and performance of the OutVoice Platform, and to facilitate delivery and execution of the Services to Registered Users.

Information and data provided by or collected from Users may also be used to detect and prevent fraud, to monitor and identify misuse or improper use of the Platform or Services, to enable and ensure OutVoice’s compliance with its legal obligations, and to resolve disputes and enforce legal agreements and policies.

OutVoice may also use information and data provided by Users for the purpose of improving the operation of the Platform and Services and further developing the services OutVoice offers through the Platform.

 

Information For Processing Of Payments

The OutVoice Platform facilitates the payment by businesses, such as publishers and their editors, to freelance independent contractors as an essential part of the Services. OutVoice primarily uses the third-party payment services of Stripe, Inc., Wise, and PayPal as its third party payment service providers for the processing of such payments and transactions.

OutVoice may not directly collect or store such payment information. That information is provided directly to the third-party payment services provider whose use of such information is also governed by their privacy policies. Payment providers maintain their own processes and undertake their own efforts to protect the privacy and security of personal and financial information provided to them to process payments and transactions. Disclosures And Sharing Of Information To Third Parties

OutVoice will not disclose, share or sell identifying information collected from or provided by Users to outside third parties, except in the following circumstances:

OutVoice may disclose information to OutVoice’s partners, vendors, and other affiliates that maintain servers and software that host and support the OutVoice Platform and or store User information and data. This includes disclosing information to OutVoice’s payment services providers through the OutVoice Platform and or who provide communication services for OutVoice.  These disclosures are necessary in providing OutVoice’s services to You.

OutVoice may disclose User information without consent for security purposes, when required by law, to comply with a court order or subpoena, to cooperate with a law enforcement investigation or to prevent imminent harm to any person or entity. OutVoice reserves the right to report to law enforcement agencies any activities that OutVoice in good faith believes to be unlawful. Release of information for security purposes shall be based on a determination made solely by OutVoice, exercising its good faith discretion.

OutVoice and its third-party payment providers use cookies.  These cookies collect information and data from both Registered Users and unregistered visitors to the OutVoice Site.

Retention Of User Personal Information And Data

OutVoice will generally retain Your personal information and data as long as you keep your Account open and for as long as is necessary for the purposes set out in this Privacy Policy.   In addition, OutVoice will retain and use Your personal information and data to the extent necessary to comply with Our legal obligations, such as compliance with applicable tax reporting laws, to resolve disputes, and to enforce Our legal agreements and policies.

OutVoice may also retain usage-related data for internal analysis purposes. Information From Persons Under 18

OutVoice relies upon the data security practices and services of its third-party service providers. OutVoice utilizes Amazon Web Services, Inc. and Digital Ocean, Inc. for hosting of the OutVoice Platform and storage of the information and data collected from Users. Amazon Web Services, Inc. and Digital Ocean, Inc. maintain their own data privacy and security measures. While OutVoice strives to protect Your information and privacy, it cannot guarantee the security of information provided to OutVoice. Users of the OutVoice Platform and Services are encouraged to take appropriate security measures when accessing and providing information through the OutVoice Platform. Data Retention

We may also retain it to allow for fraud monitoring, detection and prevention activities. We or our third-party payment providers may also keep certain personal data to comply with tax, accounting, and financial reporting obligations. We may retain personal information and data in accordance with any limitation periods and records retention obligations imposed by applicable law.

 

Disclaimers

This Privacy Policy does not extend to anything that is inherent in the operation of the Internet, and therefore beyond OutVoice’s control, and is not to be applied in any manner contrary to applicable law or governmental regulation.
